Nav Technologies, Inc., (“we” or “us”) wants you to be familiar with what information we collect about you, how the information is being used and what choices you have regarding the collection and use of the information. This Privacy Policy (the “Policy”) describes our practices in connection with information that we collect through our websites (collectively, the “Sites”), our mobile applications (collectively, the “Apps”), HTML-formatted email messages that we send to you that link to this Policy or other communications with you, and offline business interactions you have with us. Collectively, we refer to the Sites, Apps, emails, and offline business interactions as the “Services.” Please take a moment to review this Policy and feel free to contact us with any questions at nav.com/contact.

You can determine when this Policy was last revised by referring to the “Last Revised” legend at the top of this page. Any changes to our Policy will become effective upon our posting of the revised Policy on the Services. We encourage you to review the Services from time to time for changes to our Policy.

WHAT TYPES OF INFORMATION DO WE COLLECT ABOUT YOU?

We collect personal information through the Services. Personal information is information that identifies you as an individual or relates to an identifiable individual. We also collect information automatically, as described below.

Personal information. Our Services collect the following types of personal information:

  • Information provided by you when ordering credit-related products through the Services. For example, you will be required to submit personal information such as your name, address, social security number, date of birth, telephone number and e-mail address.
  • Information from third-party data providers, including consumer credit information, when fulfilling information requests made by you when ordering credit-related products through the Services.
  • When you make a purchase through the Services, we may collect your credit card number or other payment account number, billing address and other information related to such purchase (collectively, “Payment Information”) from you.
  • Information you provide us through customer service correspondence and general feedback.
  • Bank account and transaction information provided by you to Nav, directly or through a third-party data provider.
  • Other information we collect from you, such as city of birth and mother’s maiden name, is used to verify your identity in the event you forget your login information required for our online products.
  • We also collect information (e.g., your geographic location) when you voluntarily provide such information to us. We may aggregate personal information in a manner such that the end-product does not personally identify you or any other user of the Services, for example, by using personal information to calculate the percentage of our users who have a particular telephone area code. 

We need to collect personal information in order to provide the requested Services to you.  If you do not provide the information requested, we may not be able to provide the Services. If you disclose any personal information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Policy.

Information collected automatically. When you use our Services, we may collect information automatically, such as a catalog of the Site pages you visit. This information is generally collected by us and our service providers through the Services from the following sources: server log files, your browser or device, cookies, pixel tags and other similar technologies, information that you voluntarily provide, and your use of our Apps.

  • Server Log Files. Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, for purposes such as calculating Site usage levels, helping diagnose problems with the Sites’ servers, and administering the Sites. We may also derive your approximate location from your IP Address. 
  • Your Browser or Device. Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Services you are using. We use this information to ensure that the Services function properly. 
  • Cookies and Similar Technologies. We, our service providers, and/or non-affiliated third parties, may use cookies, pixels, clear gifs, web beacons, and similar online tracking technologies (collectively, “Cookies”) on the Services. Cookies allow us to collect such information as browser type, time spent on the Services, pages visited, language preferences, unique identifiers, content you view, click on, or share, screen actions, and other traffic data, including to determine which areas and features of the Services are popular and count visits. 

This information is used for security purposes, to power the interactive features of our Services, to facilitate navigation, to display information more effectively, to personalize your experience, to develop and improve the performance, functionality, and design of the Services, for advertising, and to help keep the Services free of bugs or errors. We also gather statistical information about use of the Services in order to continually improve their design and functionality, understand how they are used, and assist us with resolving questions regarding the Services. Cookies are also used to track the actions of users of the Services (including email recipients), conduct advertising, measure the success of our marketing campaigns, and compile statistics about usage of the Services and response rates. 

Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are on the Services. We may also use Cookies in online advertising to track responses to our ads. 

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular website, to your computer. You may also wish to refer to http://www.allaboutcookies.org/manage-cookies/index.html. At this time, we do not respond to ‘Do Not Track’ signals.

  • Analytics. We use Google Analytics, which uses Cookies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. You can learn about Google’s practices by going to www.google.com/policies/privacy//,  and exercise the opt-out provided by Google by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.
  • App Usage Data. When you download and use one of our Apps, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.

If you are based in the United States, Nav may use Plaid, Inc. (“Plaid”) to connect your Nav account with your bank account, verify your bank account and confirm your bank account balance prior to approving a transaction. Information shared with Plaid is treated by Plaid in accordance with its Privacy Policy, available at https://plaid.com/legal/#end-user-privacy-policy.

HOW DO WE USE THE INFORMATION COLLECTED?

Personal Information. We and our service providers may use personal information we collect in the following ways:

  • Fulfillment of Requests and Product Improvement. We may use personal information collected about you to provide you with products, services or information that you request. Additionally, we may share your information with our affiliates and other third parties to provide you with specific commercial finance products such as credit cards and loans as well as to enhance the products and services provided to you. For example, this may include providing personal information to business and personal credit reporting agencies in order to assist you in establishing and expanding a credit file.
  • Administrative Communications. From time to time we may use personal information to send to you important information regarding the Services, or changes to our terms, conditions, and policies. Because this information may be important to your use of the Services, you may not opt-out of receiving such communications.
  • Other Communications. From time to time, we may use personal information to inform you of products, programs, services and promotions that we believe may be of interest to you. If you would prefer that we do not send such email marketing messages to you, please see the “Your Choices” section below.
  • Purchases. We may use personal information, including Payment Information in order to fulfill your purchase.
  • Internal Business Purposes. We may also use personal information for our internal business purposes, such as data analysis, audits, fraud prevention and security monitoring, developing new services, maintaining and improving our current services, identifying usage trends, and determining the effectiveness of our promotional campaigns. In addition, we may also use personal information to enhance our information and to aid us in providing our customers with targeted promotions.
  • Aggregating and/or Anonymizing Personal Information. We may aggregate and/or anonymize personal information so that it will no longer be considered personal information. We do so to generate other data for our use, which we may use and disclose for any purpose, as it no longer identifies you or any other individual. Banking and Transaction Information. Nav may use banking and transaction information provided by you to Nav, directly or through a third-party (Ex: Plaid), for any lawful purpose as described in this Policy.

We may use and disclose information collected automatically for any purpose, except where we are required to do otherwise under applicable law.  If we are required to treat the information as personal information under applicable law, we may use and disclose it for the purposes for which we use and disclose personal information, as detailed in this Policy.  In some instances, we may combine information collected automatically with personal information.  If we do, we will treat the combined information as personal information so long as it is combined.  

We may, along with our affiliates and marketing partners enhance and/or merge personal information about you with data collected from other sources and use it in direct and/or online marketing and, to the extent permitted by law, individual reference and look-up service programs. In the event we enhance and/or merge such personal information with data collected from other sources, we will take reasonable steps to maintain the integrity and quality of that information.

DO WE DISCLOSE INFORMATION TO THIRD PARTIES?

We may disclose information about you to affiliated and non-affiliated third parties.

  • Affiliates. We may disclose the information that we collect to our affiliated companies to provide the products you request, to enhance our products to better suit your needs, and from time to time for marketing purposes.
  • Business Partners. We may partner with other companies to offer you products or services or to fulfill the products or services that you order. We may disclose personal information collected about you to such third-party partners for the purposes described in this Policy.
  • Non-Affiliated Third Parties. We may share personal information with non-affiliated third parties for their commercial use and benefit. For example, to report tradelines associated with Nav products and to enhance the credit report data provided to you, we may disclose personal information to credit reporting agencies. 
  • Service Providers. We disclose personal information to our third-party service providers who provide services including but not limited to data analysis, information technology and related infrastructure provision, order fulfillment, fraud prevention, list enhancement and other administrative services. We may disclose personal information to such third parties for the purpose of enabling these third parties to provide services to us. Such services may include: marketing distribution, email list management services, advertising, certain product functionalities, customer support, Site and App hosting (including through provision of tools that enable us to analyze your interactions on our Services), customer data management and enhancement, fulfillment services (e.g., companies that fill product orders or coordinate mailings), research and surveys, data analysis and email service.
  • Assignment. We reserve the right to transfer any and all information that we collect from Site users to an affiliate or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
  • Law Enforcement; Emergencies; Compliance; Other Purposes Permitted by Law. Notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose personal information to others as we believe appropriate (a) to comply with legal process; (b) to respond to governmental requests; (c) to enforce our Terms of Use; (d) to protect the rights, privacy, safety or property of Nav, Inc., our affiliated companies, you or others; (e) to permit us to pursue available remedies or limit the damages that we may sustain; and (f) for any other purpose permitted by applicable law.
  • Aggregated, De-identified, or Anonymized Information. We may share aggregated, de-identified, or anonymous information we collect with third parties, including affiliates.
  • Mobile Information. The mobile information gathered in the SMS opt-in during account creation will not be shared or sold to third parties for the purpose of SMS promotion.

YOUR CHOICES

You have choices when it comes to updating your information and receiving commercial email:

  • Nav Technologies, Inc. Commercial Email. If you prefer not to receive emails from us about offers and Promotions please unsubscribe via the unsubscribe link in an email, or contact us at nav.com/contact.
  • Changing information. Corrections or updates to your information including your email address, phone number, mailing address, credit card information or password reminder phrase can be made through the edit profile section of your account on the Services. If necessary, other corrections or updates to your information can be made by contacting a customer care representative at nav.com/contact. For your protection, our customer care representatives may request supporting documents before making any changes or updates to your membership information.

THIRD-PARTY ADVERTISING 

We use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services.  You may receive advertisements based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties.  These companies place or recognize a unique cookie on your browser (including through the use of pixel tags or similar tracking technologies).  They also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop.

HOW DO WE PROTECT YOUR INFORMATION?

We have security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please notify us of the problem as soon as possible by contacting us in accordance with the Section “Contacting Us” below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).

THIRD-PARTY LINKS

This Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

 If you provide any personal information through any such third-party website, your transaction will occur on the third party’s website (not our Services) and the personal information you provide will be collected by, and controlled by the privacy policy of, that third party. We recommend that you familiarize yourself with the privacy policies and practices of any third parties. PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.

In addition, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Twitter, Instagram, YouTube, Pinterest, LinkedIn, Apple, Google, Microsoft, or any other app developer, app provider, social media platform, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our Services.

JURISDICTION AND CROSS-BORDER TRANSFER

We control and operate the Services from the United States, and the Services are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. We do not represent or warrant that the Services, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Services do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the Services’ availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. We may store and process your personal information in any country where we have facilities or in which we engage service providers.  By using the Services, you understand that your information may be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

CALIFORNIA PRIVACY RIGHTS

California residents may be entitled to additional rights over their personal information. For more information about those rights and how to exercise them, please see our California Consumer Privacy Act Notice here, which is incorporated by reference into this Policy.

A SPECIAL NOTE REGARDING INDIVIDUALS UNDER 18 YEARS OLD

Our Services are not directed to individuals under the age of eighteen (18), and we do not knowingly collect personal information from individuals under 18. We request that individuals under 18 not provide personal information through the Services. If you are under 18 years of age, you may browse our Services; however, you may not provide personal information to us such as name, address, or email address, and you may not register for, enroll in, and/or make product purchases.
